Terms of Use
These Terms apply to apps published by Michele Berardi, including PokeGPT, the NY Marathon app, and Pizzino. By using the apps, you agree to these Terms.
01 — Use of the Apps
You may use the apps for lawful, personal, and informational purposes. You agree not to misuse the apps, interfere with their operation, attempt unauthorized access, overload the services, or use them to harm others.
02 — App-Specific Terms
- PokeGPT: AI-generated responses may be inaccurate, incomplete, or inappropriate. Do not rely on the app for medical, legal, financial, emergency, or other high-stakes decisions.
- NY Marathon app: The app is informational or utility-focused. It is not an official NYRR app unless expressly stated in the app listing.
- Pizzino: The app may be anonymous, but you may not use it for harassment, threats, illegal activity, spam, abuse, or sharing sensitive personal information about others.
03 — AI and User Content
For AI-powered features, you are responsible for the content you submit. You should not submit confidential, highly sensitive, illegal, or harmful content. AI output is generated automatically and does not represent professional advice or a guaranteed factual statement.
04 — Safety and Moderation
We may limit, suspend, block, remove, or investigate use of the apps if we believe the apps are being misused, used abusively, used illegally, or used in a way that may harm users, systems, or third parties.
05 — Privacy
Your use of the apps is also governed by our Privacy Policy, which explains what data may be collected and how it may be used.
06 — Third-Party Services
Some apps may depend on third-party services, including OpenAI, Firebase, Google, Apple, or other infrastructure providers. We are not responsible for third-party services outside our control, but we use them to provide app functionality, security, storage, or AI processing.
07 — Availability
The apps are provided on an "as is" and "as available" basis. We may update, change, suspend, or discontinue any app or feature at any time. We do not guarantee that the apps will always be available or error-free.
08 — Limitation of Liability
To the fullest extent permitted by law, Michele Berardi is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from your use of or inability to use the apps.
09 — Changes
We may update these Terms from time to time. If we make material changes, we will update the effective date on this page. Continued use of the apps after changes means you accept the updated Terms.
